Traveinstein Terms and Conditions of Use

Welcome to Traveinstein, your ultimate travel companion and social travel network. Traveinstein ("we," "us," or "our") is a mobile application ("App") that combines advanced travel planning tools with social features, such as chat, social posts, and location-based recommendations, to enhance your travel experience. By accessing or using the App, you agree to these Terms and Conditions of Use ("Terms"). If you do not agree to these Terms, please refrain from using the App.

1. Acceptance of Terms

  • You are at least 12 years of age and meet the minimum age requirements as per local laws.
  • You have the legal capacity to enter into this agreement.
  • If you are using the App on behalf of a company or organization, you have the authority to bind that entity to these Terms.

Your use of the App constitutes your acceptance of these Terms, including the collection and use of data as outlined herein.

2. License to Use the App

  • Access and use the App for personal, non-commercial purposes.
  • Share content, interact with other users, and utilize the App's social and travel planning features.

This license does not include the right to:

  • Modify, distribute, or resell any part of the App.
  • Reverse engineer or attempt to extract source code from the App.
  • Create derivative works of the Licensed Application, any updates, or any part thereof (except as prohibited by law).

3. Features and Services

3.1. Travel Planning Tools

  • Custom Itineraries: Generate personalized travel plans tailored to your preferences.
  • Location-Based Recommendations: Discover attractions, landmarks, and dining options nearby.
  • Translation Tools and Visa Checker: Navigate foreign destinations with ease.

3.2. Social Features

  • Social Feed: Post updates, photos, and reviews about your travel experiences.
  • Chat Functionality: Connect with friends or other travelers through private and group chats.
  • User Discovery: Find and interact with nearby users based on shared travel interests.

3.3. Credit-Based System

  • In-App Purchases: Use credits for advanced features, such as generating custom itineraries.
  • Pricing:
    • 1 Credit: $9.99 USD
    • 2 Credits: $18.99 USD
    • 3 Credits: $24.99 USD
  • Note: Credits are non-refundable.

4. Data Collection and Usage

To provide tailored services and enhance your experience, Traveinstein collects and processes user data in accordance with its Privacy Policy.

4.1. Types of Data Collected

  • Personal Information: Name, email address, and profile picture (optional).
  • Location Data: Real-time GPS data to recommend nearby attractions, connect users, and enable location-based features.
  • Usage Data: Information on how you interact with the App to improve functionality.
  • Social Content: Posts, chats, and shared media created or shared on the platform.

4.2. Data Usage

  • Personalize recommendations and improve App features.
  • Facilitate social interactions, such as chat and user discovery.
  • Enhance security, detect fraud, and comply with legal obligations.

You retain ownership of any content you create but grant us a license to use it for providing services and promoting the App.

5. User Responsibilities and Conduct

  • Use the App in compliance with applicable laws and regulations.
  • Respect other users and refrain from posting harmful, offensive, or inappropriate content.
  • Keep your account credentials secure and notify us immediately of any unauthorized access.

Prohibited Activities

  • Sharing content that is illegal, defamatory, obscene, or infringing on others' rights.
  • Engaging in harassment, spamming, or impersonation.
  • Attempting to hack, disrupt, or exploit the App's systems or other users.

6. Third Parties

Traveinstein may contain links to third-party websites or services that are not owned or controlled by the Company. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

7. Privacy and Security

While we implement robust security measures to protect your data, you acknowledge that no system is entirely secure. By using the App, you accept the risks associated with sharing personal and location-based information online.

8. Intellectual Property

All content, trademarks, and features of the App are the property of Traveinstein or its licensors. Unauthorized use of any intellectual property is strictly prohibited.

9. Termination and Suspension

We reserve the right to suspend or terminate your account without notice if you violate these Terms or engage in prohibited activities.

10. Modifications to the App and Terms

We may update or modify the App and these Terms periodically. Changes will be effective immediately upon posting. Continued use of the App constitutes acceptance of these changes.

11. Limitation of Liability

To the maximum extent permitted by law, Traveinstein will not be liable for any damages, including but not limited to: loss of data or privacy due to unauthorized access, disruptions caused by system errors, or actions or content of other users.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, USA. Disputes will be resolved exclusively in the courts of the State of New York.
