Welcome to Traveinstein your ultimate travel companion and social travel network. These Terms and Conditions of Use (Terms) form a legally binding agreement between you and Traveinstein (Traveinstein, we, our, or us) regarding your access to and use of the Traveinstein mobile application (the App) and all related services, features, and content.

By downloading, installing, registering an account, or otherwise accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms or any part of them, you must stop using the App immediately.

1. ELIGIBILITY AND ACCEPTANCE OF TERMS

1.1 Minimum Age Requirement

You must be at least 12 years old to use Traveinstein. If you are under 18, you represent and confirm that you have the permission of a parent or legal guardian to use the App. If your local laws require a higher minimum age, you must comply with that requirement.

1.2 Legal Capacity

By using the App, you confirm that you have the legal capacity to enter into a binding contract. If you are using the App on behalf of an organization or company, you represent that you are authorized to bind that entity to these Terms.

1.3 Acceptance of Changes

We may update these Terms from time to time. Changes take effect immediately once posted within the App or on our website. Continued use of the App after updates means you accept the revised Terms.

2. LICENSE TO USE THE APP

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on your personal mobile device for your own personal, non-commercial use.

2.2 Restrictions

You agree not to:

• Translation & Visa Checker: Access translation tools and check visa requirements for different countries.

3.2 Social Features

• Chat & Groups: Connect with friends, other travelers, or local communities via private or group chats.
• User Discovery: Find and interact with travelers nearby who share similar interests.

3.3 Credit-Based System & Purchases

• Some advanced features (e.g., custom itinerary generation) require the use of credits.
• Pricing:
  • 1 Credit: $9.99 USD
  • 2 Credits: $18.99 USD
  • 3 Credits: $24.99 USD
• Credits are non-refundable, even if unused.
• We reserve the right to change pricing or add new premium features with or without notice.

4. DATA COLLECTION AND PRIVACY

4.1 Information We Collect

• Personal Information: Name, email address, and optional profile picture.
• Location Data: Real-time GPS information to provide travel recommendations and enable location-based social features.
• Usage Data: Device information, interaction data, and activity logs to improve App performance.

4.3 Your Rights

• You own all content you create (e.g., posts, reviews, images).
• By posting or uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for operating and promoting the App.
• You can delete your account or content at any time, subject to our Privacy Policy.

5. USER RESPONSIBILITIES & CONDUCT

You agree to:

• Use the App lawfully and respectfully.
• Keep your login credentials confidential.
• Report any unauthorized use of your account promptly.

You agree not to:

• Post, share, or transmit content that is illegal, defamatory, obscene, harassing, threatening, hateful, or infringing on others rights.
• Engage in spamming, phishing, or scams.
• Impersonate another person or misrepresent your identity.
• Attempt to disrupt, hack, or exploit the Apps systems.

Violation of these rules may result in account suspension or termination.

6. THIRD-PARTY SERVICES AND LINKS

• Traveinstein does not control or endorse these third parties and is not responsible for their content, privacy practices, or security.
• You are encouraged to review the terms and privacy policies of any third-party service before using it.

7. PRIVACY & SECURITY

• We implement reasonable technical and organizational measures to protect your personal data.
• However, no digital platform is 100% secure. By using the App, you acknowledge the risks associated with online data sharing.
• You are responsible for maintaining the security of your device and account credentials.

8. INTELLECTUAL PROPERTY RIGHTS

• All logos, designs, trademarks, software, text, graphics, images, and features of the App are the exclusive property of Traveinstein or its licensors.
• Unauthorized copying, modification, or use of our intellectual property is strictly prohibited.
• You retain ownership of your user-generated content but grant us the rights described in Section 4.3.

9. ACCOUNT SUSPENSION & TERMINATION

We may suspend or terminate your account if:

• You violate these Terms or applicable laws.
• You engage in fraudulent, harmful, or disruptive activity.
• We suspect unauthorized use of your account.

If your account is terminated, you may lose access to your data and purchased credits without refund.

10. CHANGES TO THE APP & SERVICES

• We may update, enhance, or remove certain features of the App at any time.
• We are not liable for any inconvenience caused by service interruptions, updates, or changes.

11. DISCLAIMERS AND LIMITATION OF LIABILITY

The App is provided as is and as available, without warranties of any kind.

To the maximum extent permitted by law, Traveinstein is not liable for:

• Loss of data or privacy due to unauthorized access.
• Service disruptions or technical errors.
• Content or actions of other users.
• Any indirect, incidental, or consequential damages.

Your sole remedy for dissatisfaction with the App is to stop using it.

12. GOVERNING LAW & DISPUTE RESOLUTION

• These Terms are governed by the laws of the State of New York, USA.
• Any disputes or claims arising from these Terms will be handled exclusively in the state or federal courts located in New York.
• By using the App, you consent to this jurisdiction and venue.

13. AGE & PARENTAL RESPONSIBILITY

• The App is not designed for children under 12.
• If a user under 12 accesses the App, their parent or guardian is responsible for supervising usage and ensuring compliance with these Terms.
